THE CITY OF FIFTY LAKES
MASTER ROAD POLICY
AUTHORITY: At the request of the Council, the road committee writes road policy, reviews all road projects and anything else with respect to roads for subsequent recommendation to Council for their approval. Council will refer any exceptions to Committee for review.

DETAIL OF CATEGORIES:
C-1. Newly platted roads:
A. CONSTRUCTION - Roads will be paved (bituminous) and must be constructed in accordance to accepted engineering practices and be approved by City engineer or designate and the Council. Refer to Road Ordinance 2004-00. (Number to change).
B. FINANCING - Developer is responsible for all road development costs including all costs incurred by the City of Fifty Lakes. This includes, but is not limited to: bonding (125%), survey, land acquisition, legal fees, site preparation, finish landscaping, engineering, wetland mitigation, materials and labor.
C. LOCATION - The location of all new roads must be approved by Council.
D. NEW ROADS - All new roads will be platted, and are public roads subject to Council approval.
E. Developer will make provisions to make sure all lots have platted public road access to public roads.

F. APPROVAL - A 3/5ths majority vote of the Council is required for approval of any project.
C-2. Road improvements of existing roads for land development purposes.
A. CONSTRUCTION – Refer to C-1, A.
B. FINANCING – Refer to C-1, B.
C. Right-of-Way (ROW) - A 66 foot ROW (platted) will be obtained by the developer.
D. ACCESS ROADS – The entire length of a road that is used to access a development may have to be upgraded to a platted public road to City standards at developer’s expense, subject to decision by City Council.
E. APPROVAL - A 3/5ths majority vote of the Council is required for approval of any project.
C-3. I. Road improvements of existing public roads in existing developments.
A. INITIATION – Refer to assessment policy.
B. CONSTRUCTION – Upgrading of existing roads will be done with regard given to existing conditions such as: ROW (platting), road use, and achieving “country lane character” of road. Road bed realignment may be necessary on a case by case basis.
C. FINANCING – Subject to assessment policy (Refer to Assessment Policy).
D. APPROVAL – A 3/5ths Council vote if by approved petition, or 4/5ths Council vote if by Council decree is required for approval of any project.
C-3. II. Assumption of private roads
A. INITIATION – Refer to assessment policy.
B. CONSTRUCTION – Refer to C-1, A.
C. FINANCING – Refer to C-1, B.
D. All costs associated with obtaining adequate right-of-way either through the voluntary conveyance of right-of-way through a deed to the City or involuntary through eminent domain or any other public method will be considered a project expense for assessment purposes.
E. Benefiting property owners on subject road must select a project manager to act as the developer. Before the start of any project, City approval is required.
F. APPROVAL - A 3/5ths majority vote of the Council is required for approval of any project.
